  • Updated Specialty Occupation Criteria: The revised regulations make it easier for companies to identify which jobs are eligible by providing a clearer definition of specialty occupations.
  • Qualifying Degree Fields: As long as the degree fields are closely relevant to the employment requirements, the rules allow for greater freedom in accepting them.
  • Automatic Cap-Gap Extensions: To prevent interruptions in lawful status and job authorization, F-1 students who wish to switch to H-1B status will automatically be granted an extension of their student visa.
  • Better and expedited processing times: The new regulations are designed to speed up processing times, cut down on delays, and improve assistance for existing H-1B holders.

Other key updates

  • Updated Form I-129: In order to comply with the new H-1B regulations, USCIS will release an updated version of Form I-129, Petition for a Non-immigrant Worker, on January 17, 2025.
  • Annual ceiling: The H-1B visa category currently has an annual ceiling of 65,000, with 20,000 H-1B visas granted to foreign nationals who have earned a master’s degree or above from an American university.
